2017年 7月,籍 轮在中国某港口接受检查时被滞留,船旗国对其中一项滞留缺陷提出复议。缺陷如下

Findings:
The equipment contained in the electrical equipment room is as follows:
1.Air conditioning duct
2.Auto telephone exchange
3.VSAT terminal
4.Battery Charging and discharging board
5.VDR unit and DSCU for VDR unit
6.Doppler Sonar
7.Gyro Compass adaptor
8.Marine ballast for high pressure sodium lamps
The deck separating the electrical equipment room and the below accommodation spaces is insulated to an 'A-60' rating.
Based on the equipment in the electrical equipment room, the space can be assigned to two categories:
1.Control Stations - contains the equipment listed above and none of the machinery in regulation 3.30 of SOLAS Ⅱ-2
2.Other Machinery Spaces - electrical equipment room, auto-telephone exchange, air- conditioning duct spaces
The required fire integrity for boundaries of a space assigned to 'Other machinery spaces' are:
1.Bulkhead between the room and Wheelhouse: A-15
2.Deck between the room and the below accommodation spaces: A-0
3.Deck between the room and the below laundry space: A-0
The required fire integrity for boundaries of a space assigned to 'Control stations' are:
1.Bulkhead between the room and Wheelhouse: B-0 (lesser than the above)
2.Deck between the room and the below accommodation spaces: A-60 (greater than the above)
3.Deck between the room and the below laundry space: A-15 (greater than the above)
Considering the facts that the fire grows upward and the engine room, which has the highest tire risk, is located beneath the accommodation spaces, we believe that the fire integrity of deck must have priority over that of bulkhead/door as similar discussion is shown in Introduction of IMO SSE3 document (attached in Enclosure 2) and subsequent MSC. 1/Circ. 1581 (attached in Enclosure 3).
Accordingly, this Room is to be regarded as 'Control stations' and bulkhead/door between Radio Equipment Room and Wheelhouse is allowed to be 'B-0' rating, applying the footnote (e) of SOLAS Ⅱ-2, Reg.9 Table 9.6.
Conclusion: The electrical equipment room adjacent to the bridge of the ABIGAIL N should be classified as a “Control Station” with a bulkhead insulation of B-0. We respectfully request the PSC in MSA review the situation too, request this deficiency and detention be removed, and the record at the Tokyo MOU and IMO be amended accordingly.
1.事实如下在电器设备间内包含了,空调通风、自动电话交换机、 VSAT终端、电池充放电板、 VDR单元、测深仪、电罗经转换器、高压钠灯。电气设备间与下部的生活区甲板已经采取了 A-60隔离。对于电器设备间存在两种分类方式,方式一,作为控制站;方式二作为其他机器处所(分类依据见上述文件)。
2.考虑道火灾主要来源于机舱,我们认为甲板的防火重要性高于舱壁,并且这已经在 SSE3的文件以及 MSC文件中讨论过了。
3.当电器间被看做是控制站,那么其与驾驶台之间的舱壁分隔可以是 B-0级的。
04、港口国意见
As our PSCO’s judgement, this room, containing “1.Air conditioning duct and 2. Auto telephone exchange”, is to be regarded as Other Machinery Spaces -Electrical equipment rooms (auto-telephone exchange, air-conditioning duct spaces), which clearly and definitely stated in SOLAS74-2000 amendment, ChapterII-2, Reg9.2.3.3.2.2.(7). The required fire integrity for bulkhead between wheelhouse and electrical equipment room (other machinery spaces) shall be A-15We noticed your opinion according to your ysis conclusion as stated in this appeal letter -“Accordingly, this Room is to be regarded as `Control stations` and bulkhead/door between Radio Equipment Room and Wheelhouse is allowed to be `B-0` rating, applying the footnote (e) of SOLAS II-2, Reg.9 Table 9.6.”.We wonder how this room is considered as Radio Equipment Room in your opinions. We found only one set of radio equipment in this room --VSAT terminal, from your finding and the attached file -ABIGAIL N Electrical Equipment Room Details. As well-known, the VSAT terminal is used as the commercial communication for ship or crew telephone call or email. Such equipment is not the required radio installations by Chapter IV of Solas74 as amended. Such space can not be regarded as Radio Equipment Room (Control stations). So the footnote (e) of SOLAS II-2, Reg.9 Table 9.5 & 9.6 can not be applied to this case. Accordingly, the bulkhead/door between such Room and Wheelhouse is not allowed to be “B-0”.
1.本房间内包含了自动电话交换室与空调管道处所,毋庸置疑为公约定义的其他机器处所;
2.VSAT终端为商用设备,与公约中定义的无线电设备不同,此房间不可以定义为无线电设备间 (控制站 ),脚注不适用本案例。
3.为了确相邻处所界限面的耐火完整性标准,这些处所按着其失火危险程度分为以下列 1至 11类。如果某一处所的内容和用途致使按本条规定进行分类存在疑问,或有可能为某一处指定两个或以上类别,则该处所应按着有关类别中具有最严格的限界面要求的处所来对待,处所内小的围闭舱室,若其与处所相通的开口小于 30%,应按着单独处所考虑。
05、评议结果
鉴于多艘姊妹船存在类似的防火布置,且如果按照港口国海事局的要求纠正缺陷,需要较长时间,该船舶所属船旗国海事局向部海事局发函,请求在 3个月时间内部分船舶在采取足够临时保护措施条件下,可不视为缺陷,目前,部海事局已经通过电子邮件将此临时免除的函发至直属海事系统 55个港口国监督检查站点。
